The Messina Law Firm, LLC represents clients against adverse parties (tortfeasors); third-party carriers, or insured’s against their own insurance companies through uninsured/underinsured (UM/UIM) coverage – who have been injured in automobile, motorcycle, and semi-truck collisions throughout New Mexico. For personal injury cases we work on a contingency-fee basis, and our clients do not pay a fee unless there is a recovery in their case.
In addition to representing injured victims, the Firm pursues bad faith claims against insurance companies, and their adjusters individually, if they fail to bring about prompt, fair and equitable settlements of an insured’s claims in which liability has become reasonably clear.
Under New Mexico statutory and case law, unlawfully denying insurance policy coverage or unreasonably delaying payment may be examples of bad faith, malicious, willful, reckless, wanton, or fraudulent conduct, and may subject an insurance company to punitive damages.
The Firm also pursues auto, property, and bodily injury subrogation (i.e., loss recovery) through negotiation, litigation and arbitration. In New Mexico, the right of subrogation allows an insurer who has compensated their insured to step into the shoes of their insured and collect what it has paid in the interest of equitable principle and/or contract law.
